Rental Agreement
This Short Term Rental Agreement (hereinafter referred to as the “Agreement”) is entered into and made effective as of the signing date by and between the Property Manager/Operator (“Manager”) of Beachside VR, LLC and the Guest (collectively referred to as the “Parties”). Terms not specified in this Agreement shall be in accordance with the House Rules or the Reservation Policies, which are provided separately by the Manager.
Accommodation Terms
- Respectful Behavior: The Guest agrees to abide by all local laws and regulations and to behave in a manner that respects the rights of surrounding property owners. Quiet hours are from 10 PM to 7 AM. Violation of these terms shall be grounds for immediate termination of this Agreement without refund.
- Use of Property: The Guest shall not use the property for any illegal or unauthorized commercial purposes. Sub-leasing or exceeding the agreed-upon maximum occupancy without prior approval from the Manager is prohibited.
- Occupancy Dates: Guests are permitted to occupy the property strictly for the dates specified in their reservation confirmation. Check-in time is at 4 PM, and checkout time is at 10 AM on the departure date specified. Early arrival or late departure without prior arrangement and approval from the Manager may result in additional charges.
- Damage Responsibility and Damage Waiver: The Guest is responsible for any damages to the property caused by the Guest or their party. To cover potential accidental damage, a non-refundable Damage Waiver fee of $15 is charged to all Guests. This Damage Waiver covers the Guest for up to $250 of accidental damage to the property. The Guest must report any damage to the Manager within 24 hours of occurrence. For damages exceeding $250 or not covered by the Damage Waiver (including, but not limited to, intentional damage, theft, or gross negligence), the Guest will be responsible for the full cost of repair or replacement.
- Right of Entry: The Manager or their representative may enter the property with reasonable notice (24 hours except in emergencies) for maintenance, inspection, or in case of emergency without prior notice
- Parking: Parking is limited to designated areas. Additional vehicles must be approved by the Manager in advance.
- Events: Events or gatherings exceeding the maximum number of guests are not permitted without the Manager’s prior written consent. Unauthorized events may result in immediate termination of this Agreement without refund.
Pest Liability Release
The Guest acknowledges that the Manager has inspected the Premises and is aware of no rodents, bedbugs, or other infestations. The Guest shall ensure that all personal property brought onto the Premises are pest free. The Guest shall maintain reasonably proper housekeeping and cleanliness to avoid pest infestation. The Guest shall notify the Manager immediately of any pest infestation and cooperate with all necessary pest control efforts. If pest remediation is needed, the Guest shall comply with proper preparation for treatment and prevention. The Manager will not be held liable for any damages or loss of personal property as a result of a pest infestation or remediation.
Force Majeure Clause
Notwithstanding anything to the contrary contained herein, the Manager shall not be liable for any delays, or be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement, when and to the extent such failure or delay is caused by or results from acts beyond the Manager’s reasonable control, including, without limitation, the following force majeure events (“Force Majeure Event(s)”): (a) acts of God; (b) flood, fire, earthquake, or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order, law, or actions; (e) embargoes or blockades in effect on or after the date of this Agreement; (f) national or regional emergency; (g) strikes, labor stoppages or slowdowns, or other industrial disturbances; and (h) telecommunication breakdowns.
Indemnification Clause
The Guest agrees to indemnify, defend, and hold harmless the Manager, Beachside VR, LLC, its affiliates, officers, agents, and employees from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from the Guest’s violation of these terms and conditions or the Guest’s use of the property. This indemnification obligation will survive the termination of this Agreement.
Attorney’s Fees
In the event of any dispute arising out of or related to this Agreement, if the Manager prevails, the Guest shall be responsible for paying all reasonable attorney’s fees and costs incurred by the Manager in connection with the dispute. These fees and costs include,but are not limited to, those incurred in litigating or otherwise resolving the dispute in addition to those incurred in any appeals.
Waiver of Jury Trial (Mediation and Arbitration)
The Parties hereby agree to waive any right to a jury trial in any legal proceeding arising out of or related to this Agreement. Instead, the Parties agree to first attempt to resolve any disputes through mediation. If mediation fails to resolve the dispute, the Parties agree to submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Brevard County, Florida, and shall be conducted by a single arbitrator. The decision of the arbitrator shall be final and binding upon the Parties.
Fees Schedule
Pet Fees:
- A fee of $100 will be charged per dog for the duration of the stay.
- Cats are not allowed. Bringing a cat onto the premises will incur a fee of $500.
- Undisclosed dogs that are not pre-approved will incur a fee of $300, plus an additional $100 per dog.
- If a pet is brought to a non-pet-friendly property, a fee of $750 will be charged.
Extended Stay Pet Fee:
- For stays exceeding 30 days, a fee of $200 per dog will be charged.
Smoking Fee:
- Smoking inside the property is prohibited. A fee of $500 will be charged if smoking occurs.
Plumbing Misuse Fee:
- A fee of $350 will be charged for flushing tampons, baby wipes, condoms, or other foreign objects that can clog the plumbing system.
Unapproved Late Checkout Fee:
- An unapproved late checkout will result in a fee of $150 per hour.
Nondiscrimination Clause
Beachside VR, LLC is committed to providing an inclusive and welcoming environment for all guests. We do not discriminate on the basis of race, color, religion, gender identity, national origin, age, disability, marital status, sexual orientation, or any other characteristic protected by law. We expect all guests to adhere to this principle of mutual respect and tolerance.
Opt-In Marketing Agreement
By booking a reservation and agreeing to the terms of this Agreement, the Guest expressly opts in to receive marketing communications and promotional offers from Beachside VR, LLC via email, text message, or other digital communication methods. The Guest acknowledges and agrees that their contact information, provided at the time of booking and during their stay, may be used by Beachside VR, LLC for the purpose of sending marketing communications related to future stays, promotions, and updates about our properties.
The Guest has the right to opt out of receiving these marketing communications at any time. To opt-out, the Guest may follow the unsubscribe link in any marketing communication received, or directly contact Beachside VR, LLC at [email protected] with the request to be removed from the marketing communications list.
Emergency Contact Information
In case of emergencies, dial 911. For all other inquiries or assistance during your stay, please contact Beachside VR at [email protected] or phone (321) 382-0316. For efficient service, we recommend messaging us on the same thread as your booking confirmation or through the platform message system, such as Airbnb messages, so we can quickly identify your reservation.
Cancellation Policy
At Beachside VR, LLC, we understand that plans may change, and we strive to accommodate our guests’ needs to the best of our ability. Please note that for bookings made via Online Travel Agencies (OTAs) such as VRBO or Airbnb, their respective cancellation policies shall take precedence over the policy stated herein. For direct bookings made on our website, the following cancellation policy applies:
- Full Refund: Guests are eligible for a full refund if they cancel their reservation within 48 hours of booking, provided that the cancellation is made at least 14 days before the scheduled check-in date.
- Partial Refund: Guests who cancel their reservation between 7 and 14 days before the check-in date will be eligible for a refund amounting to 50% of the total booking cost for all nights.
- No Refund: Unfortunately, if a guest cancels their reservation within 7 days of the scheduled check-in date, no refund will be issued.
We highly recommend our guests to consider purchasing travel insurance to protect against unexpected circumstances that may necessitate the cancellation of their booking.
Chargebacks and Refunds
By completing a stay at a Beachside VR, LLC property, guests agree that they are fully responsible for the charges incurred. Guests are encouraged to resolve any payment issues directly with Beachside VR, LLC prior to initiating a chargeback. Initiating a chargeback after completing a stay, without first attempting to resolve the issue with Beachside VR, LLC, will be considered unjustified. In such cases, guests may be subject to additional fees, legal costs, and recovery expenses. Beachside VR, LLC reserves the right to contest any chargebacks and seek reimbursement from the guest for any charges and fees incurred in the process.
Agreement Acknowledgment
By selecting the checkbox or providing a virtual signature at the time of booking, the Guest hereby acknowledges having read, understood, and agreed to the terms and conditions of this Agreement as set forth above. This virtual acknowledgment serves as confirmation of the Guest’s agreement to abide by the policies, rules, and expectations outlined in this Agreement for the duration of their stay at the property managed by Beachside VR, LLC.
The act of booking through our website, email confirmation, or through any Online Travel Agencies (OTAs) where our properties are listed, and providing the required virtual signature or checkbox selection, constitutes an electronic signature as defined by the Electronic Signatures in Global and National Commerce Act (E-Sign Act) and other applicable laws. This electronic signature is legally binding and holds the same validity and meaning as a handwritten signature.
